Strangely, the world’s oldest democracy, with democratic institutions ranging back two centuries, finds itself placed on the same stage as possibly the least democratic nation, Pakistan. Both are trying very hard to legally disqualify the strongest political opponent from next year's electoral battle! In both countries, as the legal gambits leach out of courtrooms to ignite intense public debates on and off social media, there is a battle of narratives as both sides manoeuvre for political space. The only variation is that while judicial institutions in the U.S. are considered incorruptible, sadly, the same cannot be said for a military-controlled Pakistan.

These legal battles have ignited intense debates, with some perceiving them as politically motivated manoeuvres while others argue they shed light on potential criminal misconduct. As we delve into the intricate landscape of Trump's legal woes, it becomes clear that his post-presidential life is far from ordinary.

Background

The Manhattan District Attorney's Office has already made significant strides in its criminal investigation, acting against Trump's former personal lawyer, Michael Cohen. This case, stemming from a broader inquiry, has seen Cohen pleading guilty to an array of charges, including tax evasion, campaign finance violations, and providing false statements to Congress.

Further south, the Georgia Attorney General's Office has embarked on a different legal path, launching a civil lawsuit against Trump. This lawsuit centres around Trump's controversial phone call with Georgia Secretary of State Brad Raffensperger, alleging that the former President violated Georgia law by pressuring Raffensperger to overturn the results of the 2020 election. Meanwhile, in Fulton County, Georgia, the District Attorney's Office is still in the nascent stages of its investigation into Trump's activities. The outcome remains uncertain, leaving room for speculation about potential charges.

Moving to New York, the Attorney General's Office has wielded its legal authority, filing a civil lawsuit not only against Donald Trump but also against his three eldest children—Donald Trump Jr., Ivanka Trump, and Eric Trump. This lawsuit exposes a litany of alleged fraudulent practices within the Trump Organisation, including allegations of asset overvaluation and tax fraud. In a separate but equally notable legal battle, the Zervos lawsuit remains pending in court. Zervos, a former contestant on Trump's reality TV show, seeks damages from the former President for defamation.

In the midst of the legal maze surrounding former President Donald Trump, a contentious debate continues over the motivations behind these investigations and litigation. On one side of the debate, those who assert that Trump's legal woes are politically motivated argue that they are a means for Democrats to exact revenge for his political ideology. Their position is strengthened by the fact that Trump is not only a former president but also a prominent Republican figure leading the Republican nomination race and that many of the prosecutors heading these investigations are Democrats.

For instance, the Manhattan District Attorney's office, which is actively investigating Trump for alleged financial misconduct, is led by the prominent Democrat Cyrus Vance Jr. Chris Carr, a Republican, leads the investigation by the Georgia Attorney General's office into Trump's alleged role in pressuring Georgia election officials. However, Carr has faced criticism from certain Republican Party factions who believe he has not been proactive enough in scrutinising Trump's actions.

Trump's supporters contend vehemently that these investigations and lawsuits are being used to deflect public attention away from what they perceive to be the Biden administration's missteps. They highlight the challenges the nation is currently confronting, such as a struggling economy and the highest inflation levels in four decades.

In essence, Donald Trump's ongoing legal battles transcend the courtroom, becoming a microcosm of the larger political landscape. They reflect the profoundly polarised nature of American politics, where political affiliation frequently colours interpretations of events. The outcome of these legal proceedings will unquestionably have far-reaching effects, both in terms of legal accountability and the United States political discourse.

On the opposing side of the spectrum, critics of former President Donald Trump contend that the investigations and lawsuits levelled against him are not politically motivated but rather grounded in the pursuit of justice. They argue that the prosecutors involved are diligently following the trail of evidence and are bound by their duty to uphold the law, regardless of Trump's political affiliation.

One key point they raise is that the Manhattan District Attorney's investigation was set in motion long before Trump's departure from office. For instance, in the Manhattan District Attorney's investigation, Trump faces serious charges, including a purported pattern of fraud and financial misconduct encompassing asset overvaluation and tax fraud. According to the BBC (02 August 2023), the legal battle has hardly dented Mr Trump's popularity and status as the clear frontrunner for the presidential nomination. In fact, says the BBC, "the criminal charges have strengthened his position." A poll conducted in June by CBS News showed 76 per cent of possible Republican primary voters consider the classified documents case as a 'politically motivated' ploy, and 61 per cent claimed it did not change their opinion of Mr Trump. 14 per cent were polled saying that now they see him more positively.

  • While the respective camps battle out in the fight for perception, ultimately, the courts will give their judgment on Mr Trump's legal accountability, and it is imperative to await their outcomes before drawing final conclusions. There are some very interesting times ahead in the journey to the U.S. presidential elections in 2024!
  • Mr Donald Trump enjoys the undying support of a significant chunk of the right-wing Midwest constituency, which will not allow any legal manoeuvre to dampen their enthusiasm to place Mr Trump back in the White House. This position they ardently believe was stolen from him. There is nothing in the U.S. constitution that prevents anyone who has been charged or convicted to become the President. Therefore, Mr Trump remains a contender, a strong one at that, in the race.
